The drummer for the band The Fratellis has been cleared of driving under the influence of cannabis.

Gordon McRory, 42, was allegedly twice over the legal limit in Glasgow’s Laurieston on December 10, 2023.

McRory – who goes by the stage name Mince Fratelli – also faced a possession of cannabis charge.

McRory of the city’s Langside formed the successful Glasgow rock band in 2005.

The trio’s debut album Costello Music peaked at number two on the UK album chart in 2006 and 48 in the US Billboard chart.

The Fratellis also won a BRIT Award in 2007.

McRory denied the two charges and went on trial for three days at Glasgow Sheriff Court.

The court heard that police officers were alerted to McRory’s Nissan electric hybrid vehicle due to a smell coming from it.

Officers stopped the vehicle and allegedly found a small amount of cannabis inside.

Court papers state that McRory gave a drug test reading of 4.2 microgrammes of a component found in cannabis. The legal limit is two microgrammes.

The trial went to a no case to answer submission, which was prompted by McRory’s lawyer Richard Freeman.

It was argued on a legal technicality that, as the result of the drug test was not personally given to McRory, it goes against the terms of the act he was charged with.

Sheriff Michael Hanlon said: “I uphold the no case to answer submission. I was slightly confused by the wording.”

The possession of cannabis charge was dropped mid-trial.

McRory was then acquitted by the sheriff and was free to leave the dock.
