A suspect accused of shooting a man with a paintball gun during an alleged murder is to face a trial.
Mark Allison, 45, allegedly attacked Robbie Yuill at a property in Smyllum Road in Lanark last December 2.
Prosecutors claim the 33 year-old was threatened and that repeated “blunt force trauma” was inflicted by means unknown.
The charge further alleges Allison did “repeatedly discharge a paintball gun” at Mr Yuill resulting in him being struck with pellets.
It is finally said the man was also attacked on the head and body with a knife.
Allison faces a separate accusation of attempting to defeat the ends of justice.
This includes claims that he got rid of the paintball gun and went on to stay at two different hotels in Newhouse, Lanarkshire and in Dumfries.
The indictment states this was with the intention of avoiding “detection, arrest and prosecution”.
The case called for a short hearing at the High Court in Glasgow on Tuesday.
Allison’s lawyer Donald Findlay KC said: “He faces a charge of murder. The situation is fairly straight forward.
“He pleads not guilty. A special defence of incrimination has been lodged.
“This is a case that has to go to trial.”
Both Mr Findlay and prosecutor Adrian Stalker said it is hoped certain matters in connection with the evidence can be agreed.
Lord Arthurson went on to fix a trial due to begin in November 2025.
The case could last around seven days.
