A man has been cleared of killing an elderly football fan after running him over.

Martin Hume, 38, struck John Conway in Bishopbriggs on the night of January 20, 2023.

Hume was behind the wheel of a Kia Sportage on Auchinairn Road at the time.

It was alleged that he drove without due care or attention or without reasonable consideration for other people using the road.

The charge said Hume, of Bishopbriggs, failed to maintain proper observations and did not see Mr Conway.

It was stated that Mr Conway was a pedestrian crossing the road at the time.

Allegations said Hume emerged from a junction and took a right turn when it was not safe to do so.

It was stated that the manoeuvre caused Hume’s vehicle to collide with Mr Conway, damaging the car.

Mr Conway died at Glasgow’s Queen Elizabeth University Hospital 11 days later from his injuries.

Hume pled not guilty at Glasgow Sheriff Court to causing Mr Conway’s death by careless driving.

The court heard from a man who stated that he had served regular Mr Conway that night at The Campsie Bar.

The witness said that “creature of habit” Mr Conway would order the same drinks, watch football and leave to be home at 10pm.

The man told police officers in his statement that Mr Conway was “absolutely fine” when leaving the bar.

Another woman witnessed the collision moments later after dropping off a friend in her car.

She stated that the car “lit up” Mr Conway, who crossed the road in front of her.

Prosecutor Harry Findlay asked the witness where Mr Conway was on the road, and she replied: “Just past the middle lines on the middle of the road.”

The woman tended to Mr Conway who told her that he “wanted to go home.”

Mr Findlay asked the witness how the driver of the car presented and she replied: “I asked if he was okay but he was very shocked.”

The woman stated that Mr Conway was in dark clothing, wearing a hat and a hood “right up and it covered his face.”

Allan Macleod, defending, asked the woman if Mr Conway stopped in front of the car just before it collided with him and she replied: “Yes.”

The advocate asked if Mr Conway looked in the direction of the car, and the woman said: “His head was down all the time.”

Mr Macleod asked: “He walked in front of the car before it hit him?”

The woman replied: “Yes.”

Mr Macleod asked: “He wouldn’t be able to see the car before it collided with him?”

The woman replied: “Yes.”

Jurors returned a verdict of not guilty shortly after Sheriff Martin Jones KC allowed them to start their deliberations.
