Two drivers are accused of killing a woman after allegedly being in a high-speed “race” with one another.
Rory Nimmo, 25, and John Clark, 42, are said to have been involved in a crash that resulted in the death of 46-year-old mum Shona McKinlay.
The crash occurred on the A70 near Ayr in South Ayrshire on October 28, 2022.
Prosecutors claim Nimmo and Clark “engaged in a race each other” and were going at “grossly excessive speeds”.
This was despite claims Nimmo was driving while a number of tyres on his Audi TT were below the minimum legal tread depth.
Nimmo allegedly overtook Clark’s Ford Focus when it was unsafe to do so and went onto the opposite side of the road.
Clark is said to have gone faster in an attempt to stop him carrying out the manoeuvre.
The indictment claims the pair took a bend at speed before Nimmo suddenly applied his brakes and lost control of his motor.
It is said he then collided with a Renault Kangoo van driven by Ms McKinlay on the opposing side of the road.
Ms McKinlay, of Dreghorn, North Ayrshire, was said to have been left so severely hurt that she passed away.
A woman in her van was also described as being injured.
Nimmo faces two separate motor insurance fraud charges.
This includes an accusation that he took out a policy alleging he paid £4,000 for the vehicle and that the car not been changed in any way.
However, prosecutors state that he instead purchased the Audi for £150 and that it had been “extensively modified.”
The case called for a short hearing at the High Court in Glasgow on Monday.
Lawyers for Nimmo, of Cumnock, and Clark, of Drongan, both East Ayrshire, pleaded not guilty on their behalf.
Both the defence and prosecutor Alex Prentice KC said they were ready for a trial to be fixed.
Mr Prentice said: “Six days is a reasonable estimate for the duration.”
Lord Mulholland set the trial due to begin in November 2025.
Reports of the incident at the time revealed how the road had been closed off for 11 hours as police investigated.
A number of tributes to Ms McKinlay were made on social media.
She was described in one as a “beautiful and amazing person both inside and out”.
