A driver is to stand trial charged with killing a pensioner and injuring a young boy.

Leigh Sutherland is said to have been behind the wheel of a Ford Mondeo when he crashed into a Peugeot 108 driven by 77-year-old Margaret Allan on June 15, 2023.

The 30-year-old is also accused of breaching bail by speaking about the incident on a TikTok video.

Prosecutors state the collision occurred at the Condorrat ring road in near Cumbernauld.

Sutherland’s car is said to have been in a “dangerous condition” including the battery not being secured properly and the anti-lock braking system not working.

It is claimed he drove at “grossly excessive speed”.

The death by dangerous driving charge alleges he did not keep a proper lookout on the road, resulting in him hitting Ms Allan’s car.

The victim is said to have been so badly injured that she passed away in hospital on July 6, 2023.

A child in her car was also described as hurt following the incident.

Sutherland faces a separate charge, which states he was given bail by a sheriff on June 23, 2023.

A condition was that he did not make “any reference on any social media” to the crash or those involved.

However, it is claimed that on March 14, 2024, he mentioned the incident “on a video posted on TikTok.”

The case called for a hearing at the High Court in Glasgow.

John Scullion KC said: “I appear on behalf of Leigh Sutherland. He pleads not guilty.”

The advocate said a joint minute of facts – evidence agreed between the prosecution and defence – should hopefully be agreed.

Lord Clark went on to fix a trial which is scheduled to begin on September 25, 2025.

Sutherland faced a second indictment which features a charge that he did cause the death of Miss Allan while being banned from the road.

Mr Scullion told the hearing he also denies these allegations.

A separate trial was fixed for this and is due to start on October 6, 2025.

Sutherland, of Cumbernauld, remains on bail.
