NHS Tayside destroyed 40 theatre logbooks detailing operations carried out by disgraced surgeon Sam Eljamel, months after a ‘Do Not Destroy’ notice was issued.
A public inquiry heard that the hard copies, which could have contained vital evidence, were ruined in the summer.
The lawyer representing patients described it as gross negligence or possible malice.
The health board said it was an ‘error’ and that it’s sorry.
