A chip shop tried to rape an intoxicated customer after giving her a lift home.

Guray Eskicioglu, 61, preyed on the woman, who cannot be named for legal reasons, at a house in Dunfermline on April 29, 2022. 

The High Court in Edinburgh heard how Eskicioglu, also of Dunfermline, had got to know his victim through his work in a fast food outlet in the city. 

The court heard how he regularly gave her lifts and she felt safe in his company. But on the night of the offence, Eskicioglu betrayed the confidence she had in him and sexually assaulted her. 

On Tuesday, Eskicioglu was given a five-year jail term.

But before the sentence was imposed, defence solicitor advocate Gordon Martin told judge Lady Carmichael that his client had made an admission to a court appointed social worker. 

Mr Martin added: “He said he was sorry for any upset or harm that he has caused to the complainer.”

Jurors convicted the first offender of a charge of attempted rape. 

They found that he assaulted his victim while she was asleep and unable to provide consent before he removed her clothing and sexually assaulted her. 

During proceedings, Eskicioglu denied any wrongdoing. But his victim told the court how he had sexually assaulted her. 

She said that she had been on a night out with a friend and had asked the accused for a lift. She said that she felt ill during the journey and had to be sick out of his car window. 

The woman said that she had fallen asleep in Eskicioglu’s home and that she awoke at the moment of the sexual assault. 

The court heard that after she woke up, Eskicioglu continued to sexually assault her. He then attempted to rape her. 

She said: “He got on top of me… I asked him to stop. He said, ‘Just a minute’ – he said that a few times. 

“I was frozen. I got up and sat up on the side of the bed. I was asking where my stuff was.” 

She added: “I basically ran out of the door.”

The woman told the court how she had got to know Eskicioglu through visiting the chip shop where he worked and he had given her lifts on previous occasions.

She said: “He always got me home safely.”

On Tuesday, Mr Martin told the court that his client was a Turkish citizen who has lived in the UK since 1998. Mr Martin also told the court that the accused’s marriage broke down in 2021. 

The lawyer said: “He has contributed throughout his time in the UK through supporting his family and working.”

Passing sentence, Lady Carmichael said: “At the time of the offence, the complainer was intoxicated. 

“Your behaviour was both opportunistic and predatory. 

“It is clear from the information available to me that it has had a lasting impact on the victim. 

“There is no alternative to a custodial sentence.”

Lady Carmichael also placed Eskicioglu on the Sex Offenders Register for life.
