The family of a teenager who died after the car he was travelling in spun out of control and struck a lorry have launched a bid to sue the driver.
Kyle Marshall, 19, died after the car driven by his friend Charles Gray hit a “greasy corner” on the A91 near Bannockburn Interchange on March 17, 2024.
The car crossed the centre line and was struck side-on by a heavy tipper lorry coming the other way.
The impact caused “a significant intrusion” into the rear where Kyle and 17-year-old Jayden McConnell were sitting, before sending it careering down the side of the lorry next to a crash barrier, where it came to a halt.
Kyle and Jayden died at the scene of multiple injuries.
Police ScotlandGray’s then-girlfriend in the front passenger seat was not seriously hurt, however Gray himself suffered life-changing injuries.
Gray, then 17, had passed his test only the month before the crash.
He was later acquitted of causing the deaths of his two friends following a trial at Stirling Sheriff Court in 2025.
Kyle’s family has now launched a civil action in the Court of Session over the collision.
Lawyers for the family claim Gray was negligent and are seeking a six-figure sum.
A Digby Brown spokesman said “A civil action has now been raised in the Court of Session on behalf of the loved ones of Kyle to help them secure answers, support and recognition.
“It would be inappropriate to comment further at this time however we will continue to support the Marshall family during this time.”
