Rapist given life sentence after he was caught with child abuse images

A rapist who was caught storing child abuse images on his computer has been given a life sentence.

Colin Mitchell, 37, was arrested after police seized his laptop at his mother's home in Tillicoultry, Clackmannanshire, in August 2011.

Officers found he had 69 photographs and 131 videos of children being abused on the machine.

The High Court in Edinburgh heard how Mitchell had been jailed for 15 years in July 2004 at Lewes Crown Court in Surrey.

He was convicted on 16 charges of raping and indecently assaulting two boys, who cannot be identified for legal reasons, over a period of some years.

On Tuesday judge Lord Bannatyne ruled that Mitchell was a threat to public safety.

He ordered that Mitchell should be made the subject of an Order of Lifetime Restriction and should serve at least nine years and nine months before the parole board decides whether he is fit to be released back into the community.

However, if the parole board decides that he is not fit to be returned back into the community, he can remain in prison for as long as the Government considers him a threat to the wider community.

Passing sentence, Lord Bannatyne said the nine-year part of the sentence reflected the unserved part of the sentence he was released from in 2010. The nine-month portion of the sentence reflected the crime of downloading child abuse images.

Mitchell, a prisoner of HMP Barlinnie, pleaded guilty to downloading child abuse images between April 12, 2011 and August 4, 2011 at an address in Tillicoultry before Sheriff Craig Caldwell at Falkirk Sheriff Court in January 2012.

However, Sheriff Caldwell felt he was unable to deal with Mitchell and sent him to the High Court for sentencing.

Passing sentence, Lord Bannatyne said he couldn't avoid jailing Mitchell for life. He added: "There is only one disposal available to me.”
