A woman caught driving while over the alcohol limit claims she did not know the jelly she was eating was laced with vodka.
A sheriff has rejected Donna Forbes' claim that she did not intentionally drink alcohol when she was at a party in Inverness.
The 30-year-old insisted she only drank soft drinks and only later discovered that the jelly she was eating was made with vodka.
The mother-of-two had denied the drink-driving charge but her argument was rejected by sheriff Ian Abercrombie at Inverness Sheriff Court on Thursday.
He said: "After careful consideration of the evidence and all the arguments advances, I cannot hold that the accused had not involuntarily consumed alcohol on the day in the question."
Forbes previously told the court: "There was a finger buffet and there were several different varieties of jelly which I tried.
"If I had known at the time I would not have touched it.
"I couldn’t understand why I was over the limit. I was only drinking coke. A few days after being arrested I spoke to my friend who said there was vodka in the jelly.
"It is the only explanation I can think of. I have two children and would not knowingly drink and drive. I was shocked at the time."
She told the court she had gone to a party at the Portland Club in Inverness after finishing work on May 15 last year.
She was stopped yards from her home at Orchard Park. A police breath test revealed she had 52mcg of alcohol in 100ml of breath, above the legal limit of 35mcg.
Sheriff Abercrombie deferred sentence for background reports until March 1.
