An adult from the NHS Lothian board area has become the latest Scottish person to die with swine flu.
Nicola Sturgeon said the patient had an underlying health condition. This death brings the total number of H1N1 related deaths in Scotland to 39.
Health Secretary Nicola Sturgeon said: "I send my condolences to the patient's family and friends at this difficult and very sad time.
"Fortunately it is a mild illness for most, but people with underlying health conditions are at greater risk of complications which is why we are prioritising the vaccine for this group.
"We are vaccinating as soon as vaccines arrive in the country and those people who accept the invitation will be vaccinated by Christmas."
The news of the swine flu death came on the same day as it was announced that children under the age of five will be given the swine flu jab when the second phase of the Scottish vaccination programme begins in December.
The Health Secretary made the announcement at a briefing about the H1N1 virus in Edinburgh on Thursday, where she also revealed a slight increase in the number of people who have contracted the virus in the past week.
The latest figures from the Government show an estimated 21,200 people contracted H1N1 over the past seven days, with 128 admitted to hospital.
That equates to 191 per 100,000 people in Scotland, compared to 114 last week.
